These general terms and conditions of sale (hereinafter, "General Terms and Conditions") apply to all sales of products (hereinafter, "Products" or "Product") apurchased through the website www.kuboox.it (hereinafter, "Site").
The use of “distance selling service” described in these General Terms and Conditions is reserved for companies and final consumers understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activity, if any (hereinafter, "Customers" or the "Customer").
The language available to conclude the contract is "Italian".
The Customer must carefully read the General Terms and Conditions that have been made available to him/her on the website, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.
Contracts concluded with KUBOOX Srl (as defined below) through the Website, are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, no. 70 (hereinafter, "Ecommerce Decree").

1. SELLER IDENTIFICATION
The seller is KUBOOX srl, Registered Office: Via Vallina Orticella, 54 Borso del Grappa, Tax Code and VAT No.: IT04884060262, Rea Number: TV-406822 (hereinafter referred to as "KUBOOX").
2. PRODUCTS INFORMATION
The information relating to the KUBOX Products that can be sold at a distance through the Website is available, with the relative product codes, on the Website.
This information is provided in accordance with articles 52 and 53 of the Consumer Code.
3. PRICE
All prices are expressed in Euro.
4. ORDERING PRODUCTS
The essential characteristics and prices of the Products are indicated in the offer relative to each Product.
To purchase the Products, the Customer must fill in and send the electronic order form, to KUBOOX, following the instructions contained in the website. The customer must place the product in the appropriate "shopping cart" and, after having read the General Conditions, with particular reference to the contribution to delivery costs and the methods of exercising the right of withdrawal, and the Privacy Policy, must select the method of payment (PayPal & Credit Cards or Bank Transfer) and choose the option "confirm order".
Before submitting his purchase order, the Customer will have the opportunity to correct any errors in data entry by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to modify the quantity of the Products he intends to purchase by adding or removing one or more Products from the "shopping cart".
By sending the order, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase process and fully accepts the General Terms and Conditions.
The Customer will be able to view and follow the status of his order through the "My Account" area, which is accessible by "Login".
KUBOOX reserves the right to evaluate the acceptance of received orders. KUBOOX will inform the client of any impossibility to accept the orders received within 48 hours starting from the following working day, on which the client transmitted the order to KUBOOX, and will provide for the reimbursement of any sums already paid by the client for the payment of the supply.
5. PAYMENTS METHODS
KUBOOX accepts payments made in the following ways:
- Immediate payment with PayPal account without additional costs
- Immediate payment by Credit Card at no additional cost
- Bank transfer at no additional cost (the shipment will take place once payment has been verified).
6. CONFIRMATION OF ORDER RECEIPT
In accordance with the provisions of'Article 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, by e-mail, confirmation of receipt of the purchase order sent by the Customer.
7. INEFFECTIVENESS OF THE ORDER
No contract is to be considered concluded between KUBOOX and the customer if KUBOOX has grounds for believing that the customer is not acting on the basis of an effective and genuine interest in the purchase of the products ordered, or is abusively exercising the right of withdrawal.
In such cases, the order forwarded by the customer must be considered ineffective. KUBOX will send the Customer, by e-mail, a communication attesting to the non-conclusion of the Contract, also taking care of the cancellation of any charges and/or expenses borne by the Customer.
8. TRANSPORT AND DELIVERY
The Products purchased on the Website will be delivered to the Client’s address indicated by the Customer and transported by courier. In any case, the Customer has the right to request delivery of the products to a natural person of his/her choice, whose residence or domicile is located within Italian territory (including San Marino and the Vatican City). At the time of delivery, the signature of an adult over 18 years of age will be required. Deliveries to P.O. boxes will not be made.
For every order placed on the Website, KUBOOX issues a fiscal receipt/invoice for the goods shipped, inserted in the shipping package, in accordance with D.P.R. 445/2000 and D.Lgs. 52/2004. The invoice shall be issued on the basis of the information provided by the Customer when placing the order. No change in the invoice shall be possible after the invoice has been issued.
Delivery costs are borne by the Customer and are separately highlighted on the Site and in the order form.
Delivery costs amounts proportionally to the weight of the goods purchased and the delivery destination. These will be calculated dynamically during the order and shown in the order summary directly in the shopping cart.
All purchases will be delivered by Express Courier, with Standard service and without delivery notification, from Monday to Friday, excluding public holidays and national holidays. KUBOOX is not responsible for unforeseeable delays.
KUBOOX will update the status of the order on its website, including the status of the shipment.
Shipments take place within 5 working days and deliveries are normally made within 24 hours of dispatch throughout Italy and within 48 hours in Calabria and on the Islands, except in the case of unforeseen events not attributable to KUBOOX.
PFor the delivery of the goods the presence of the Customer or of a person appointed by him at the recipient's address indicated in the order. Upon delivery of the goods by the Express Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the transport document and that the package or the goods themselves are intact or not altered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately contested by means of a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the package delivered.
- - > CASES OF NON-ATTENDANCE AT THE TIME OF THE COURIER'S PASSAGE
If the package will returned to our business and will be stored at the courier's premises, we will charging the costs incurred by the courier.
If, for reasons beyond our control, you are not available at the delivery time, you may contact the office of the courier in your town and agree on a later delivery or collection from the courier's premises.
KUBOX is not financially responsible for parcels left in storage with the Courier. The customer who has not been able to agree with the office of his city an arrangement for a second delivery, or collection at the headquarters of the Courier, assumes the burden of bringing the shipment to a successful conclusion. . In the event that the courier delivers the package to us due to non-collection by the customer, KUBOOX will contact the customer for possible redelivery and will ask for a refund of any storage costs as well as the shipping costs incurred (redelivery to KUBOOX) and those to be incurred (redelivery to the customer). In the event that the customer does not intend to pay the costs incurred by KUBOOX or does not contact us in order to reach an agreement, or following our e-mail requesting reimbursement of the costs incurred, does not respond within a reasonable period of time of 7 (seven) days, KUBOOX will retain the goods not collected due to default on the part of the customer.
9. ERRORS
The information relating to the Products provided on the website is constantly updated.
However, it is not possible to guarantee the complete absence of errors.
KUBOX reserves the right to correct errors, inaccuracies or omissions even after an order has been placed and also to change or update information at any time without prior notice.
10. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions shall be governed by and construed in accordance with the Italian laws.
Any disputes arising from the interpretation, validity and/or execution of these General Terms and Conditions shall be subject to the mandatory territorial jurisdiction of the Court of Treviso,
